Medical practices are required under HIPAA to safeguard the privacy and security of patient records. But at the same time, they are required to give patients (and sometimes third parties) timely access to those records. And, since trafficking patient records costs money, practices have to charge for the task—without running afoul of laws and regulations mandating patient access.

This webinar gives you all the info you need to juggle these competing interests. Jennifer Searfoss, Esq., CPOM, CHCI, CMCS, an attorney who is also an experienced healthcare executive and administrator, will explain how to uphold patients’ right to access their records without losing money or inadvertently violating the law.

At the conclusion of this program, participants will be able to:

  • Understand the law and regulations behind practice management and handling of patient records
  • Respond appropriately to patients’ requests for their records
  • Respond appropriately to requests for patient records from third parties
  • Charge appropriately for copying and delivery of patient records under a variety of circumstances

Agenda

  • Basic laws and regulations regarding what you can charge for handling patient medical records
  • How to handle, and charge for, attorney or third-party requests for patient medical records
  • Your rights and alternatives when a patient cannot or will not pay your records handling fees
  • Charging for extra services such as requests for archived records
  • Definition of the practice’s "real costs" for medical records duplication
  • Your rights and alternatives when a patient requests records on alternative media (e.g., CD-ROM, thumb drive, paper)
  • Your rights and responsibilities regarding patient records produced by providers from other practices (e.g., x-rays)
  • Responsibility for postage costs
  • Third parties that may require you to turn over patient records
  • Your options when you receive a subpoena or court order for patient records
